前高檢署檢察官陳玉珍包庇並關說賭博性電玩，收賄高達2325萬，被冠上「史上最貪女檢」封號。繼日前遭監察院彈劾後，監委調查發現，陳玉珍收賄期間，考績竟都是甲等、品德操守也列為A(足為楷模)，昨天通過糾正陳玉珍原任職機關高檢署與新北地方法院檢察署。

針對監察院糾正高檢署一事，高檢署昨低調表示虛心接受，強調陳玉珍只是個案，未來將審慎檢討考績是否適切。

陳玉珍調任板檢(現為新北地方法院檢察署)主任檢察官時，利用各地檢署分案規則，故意將某電玩業者所涉案子，保留不結案，再以「後案併前案」的漏洞拖延不辦，長期包庇賭博業者。

陳玉珍從88年12月起至95年7月止，共收受賄2325萬元，被特偵組稱為「史上最貪女檢」，日前監院也以11比0，壓倒性通過陳玉珍彈劾案。

但陳玉珍原任職的板橋地檢署與高檢署，在陳玉珍收賄期間，歷任首長竟給予陳玉珍考績甲等，及「認真負責」、「腳踏實地」、「學養俱豐」、「明察秋毫」、「處事明快」、「視野宏觀」、「辦案迅速」評語。誇張的是，陳玉珍的品德操守項目竟被列為「足以楷模」等級。

監委趙昌平及高鳳仙指出，陳玉珍任職機關沒有詳實督考，對陳玉珍長期與電玩業者密切往來、收受賄款、關說等事實渾然不覺，讓陳玉珍可利用「後案併前案」規定不斷貪瀆，核有違失，昨天通過對高檢署與新北地檢署的糾正案。

郭瑤琪：入監之日 絕食開始

（中央社記者黃意涵台北24日電）前交通部長郭瑤琪在台北車站招標案收賄遭判刑8年定讞。她今天聲請再審時說，發監執行之日，就是她絕食抗議的開始。

郭瑤琪今天在律師李永然陪同下，到台灣高等法院聲請再審。她說，是以無比沉痛的心情來到這裡，為自己的清白做最後的努力與爭取，期待能有公正客觀的審判機會。

她並對在場媒體表示，如果循正常法律途徑，無法還她清白，「當我發監執行之日，就是我絕食抗議的開始」。

李永然說，確定判決有明顯事實錯誤存在，郭瑤琪並未收到2萬美元，因找到的新證據對她有利，更可判斷她無罪。另外，經整理相關筆錄發現，李宗賢前後陳述有多處不一且矛盾，不符邏輯經驗法則，郭瑤琪已在12月12日向台北地檢署提出偽證罪告發。

李永然說，若法院依虛偽不實的證言作為判決依據，可作為再審理由，因此依刑事訴訟法420條第1項規定提出再審聲請。1021224

刮痧時椎間盤破裂 她求償20萬

新北市李姓女子今年8月到中和一家SPA養生館按摩，美容師為她的後頸部刮痧，卻引發劇烈疼痛，經診斷為外力不當推擠，造成頸部椎間盤破裂壓迫神經，李女向消保官申訴，要求賠償20萬元，但養生館認為，李女後頸部僅按摩20秒，按摩師手部力道不會致傷，只願賠償5萬元，協商破裂。

新北市消保官周繼雄表示，李姓女子陳述，當時美容師用刮痧板，非常用力推她的後頸部，感到一陣劇痛，返家後右手也開始疼痛，甚至出現無力、抬不起來的症狀。

李女經醫師診斷，確認因外力不當推擠，造成頸部椎間盤第五、六、七節破裂，壓迫到神經，導致右手疼痛麻痺，不僅生活受影響，工作也因常請假看診而被扣錢，李女向新北市消保官申訴。

經消保官二度協商，養生館仍堅持，當天美容師為李女刮痧頸部僅20秒左右，且女性美容師手部力道，應該不至於導致椎間盤破裂，養生館主張，應是李女原本就有舊疾導致，堅持只願出5萬元賠償，最後雙方協商破裂，只能鬧上法院。

周繼雄指出，依現行制度，按摩技術士的證照仍僅限視障者報考，明眼人不需證照就可從事按摩工作，民眾若需按摩紓壓，一定要找具專業知識，有口碑的按摩美容師，若要尋求治療，就應該到合格的中醫院，由醫師進行推拿，或指示物理治療師或復健師、護理師協助，才有保障。
