台鐵南迴「搞軌」案，纏訟9年後最高法院在日前再度撤銷更二審李泰安無期徒刑判決，以相關事證未查明、判決違背法令為由將全案發回更三審詳查；對於，有法界人士認為，最高法院發回更審，並不會對既定判決「結果」發生影響，但李泰安的委任律師卻認為，勝訴空間其實相當高。

資深刑案律師陳宏彬表示，依現行實務經驗，最高法院會將案件發回更審，一般都是認為二審法院對於案件事證仍有調查未盡之處，但不必然就表示，該案件當事人是沒有犯罪事實，或前審法官有誤判等情事，兩者間不能劃上等號，發回的目的只是要把事實調查的更詳盡；從過去經驗來看，如果沒有太意外的話，李泰安還是會繼續被判無期徒刑。

不過，對於李泰安案情，委任律師吳漢成則表示，其實無罪的空間還是相當大的；吳漢成表示，隨然最高法院會將案件發回更審的理由有很多，但這幾年一般會發回更審都是因為二審判決嚴重「違背法令」所以才會發回，否則一般都是直接駁回。因此，可以從最高法院再度將全案發回更審的作為看出，二審的判決理由顯然有很嚴重的瑕疵。

吳漢成表示，整起案件從頭到尾都缺乏「物證」的基礎，結果檢方卻僅憑「人證」的傳聞證據就硬要將李泰安入罪；而且許多人可能都不知道，其實在全案6、7個證人中，法院早就認為大部份證詞都不可信，甚至像X5、B30、B32（代號）這些證人，還都是「拿檢察官的錢」，共同領取檢舉獎金的，「像這種一定幫檢察官的證人，講的證詞能信嗎？」

而吳漢成還指出，其實最高法院早在上一次發回更審時，就明確指出判決違背法令之處，甚至還以強硬的措詞指責承審法院為何仍舊未對應該釐清之犯罪事實及證據進行調查；因此，對於這次再度發回更審，他並不意外。

吳漢成表示，整起案件從頭到尾都缺乏「物證」的基礎，結果檢方卻僅憑「人證」的傳聞證據就硬要將李泰安入罪；而且許多人可能都不知道，其實在全案6、7個證人中，法院早就認為大部份證詞都不可信，甚至像X5、B30、B32（代號）這些證人，還都是「拿檢察官的錢」，共同領取檢舉獎金的，「像這種一定幫檢察官的證人，講的證詞能信嗎？」

而吳漢成還指出，其實最高法院早在上一次發回更審時，就明確指出判決違背法令之處，甚至還以強硬的措詞指責承審法院為何仍舊未對應該釐清之犯罪事實及證據進行調查；因此，對於這次再度發回更審，他並不意外。
