【黃揚明／台北報導】民進黨團今開記者會，總召柯建銘宣布明天將提出杜絕非法監聽相關修法，修法重點包括將監聽資料不得作為刑事審判以外用途，另案監聽資料無證據能力，且規範公務員或曾任公務員違法將監聽資料挪作他用，可處3年以下有期徒刑。

柯建銘說，修法範圍包括《通訊保障及監察法》、《刑事訴訟法》兩個作用法，以及《法院組織法》、《警政署刑事警察局組織條例》、《調查局組織法》三項組織法，明天提案後，希望後天程序委員會能排入本周5院會議程，並一讀交付委員會審查。

民進黨團書記長吳秉叡說，此次《通訊保障及監察法》修法,明定監聽資料不得作為刑事審判以外用途，另案監聽資料應依法銷毀；監聽所得另案資料，在另案刑事審判程序中無證據能力；檢察官聲請監聽時應釋明理由，若無法說明理由要已具結方式代替；將監聽資料挪作他用比照洩漏監聽資料課以刑責。

此外，吳秉叡說，由於現在檢警通常都直接向電信業者調取通聯記錄，為保障人民秘密通訊自由，修法將檢警取調通聯記錄也要向法院聲請核發調取票才可調閱。另外，為避免浮濫監聽，增訂監聽不得以監聽設備全面監錄後，再以人力聽取內容，也就是說，限定監聽須為「同步監聽」。

吳秉叡指出，包括監聽票聲請、核發、執行、監聽資料的保管、使用、銷毀，其經辦、調閱、接觸的人都要建立連續流程履歷記錄，並予管理系統連線，杜絕公務員執法過程中恣意侵害人民隱私權；此外，還增訂監聽結束後監聽機關若超過1個月仍未向法院陳報，承辦法官應主動通知被監聽對象。
