【大紀元2013年09月30日訊】（大紀元記者吳旻洲台灣台北報導）針對日前特偵組監聽到立法院總機案，引發朝野立委群起撻伐，立法院司法委員會30日邀請新任法務部長羅瑩雪備詢，最後臨時提案決議，要求特偵組停止目前所有的偵辦及監聽案件，改交由一般檢察機關偵辦。

日前特偵組監聽立法院總機電話，檢察總長黃世銘聲稱誤把立法院的節費電話，當成立委柯建銘助理的私人手機，但完全沒有通話內容。對此，司委會要求剛接任部長的羅瑩雪、黃世銘、高檢署檢察長陳守煌等人列席備詢。

羅瑩雪：特偵沒有主觀犯意

羅瑩雪表示，將邀請具法律專業背景的民間團體參加監聽事件調查小組，且沒預設立場，將用證據認定事實。

羅瑩雪也對於上任前曾公開表示，特偵組「沒有主觀犯意，查案方向也沒大問題」的言論，她解釋，只是與同事閒聊各種觀察角度，而沒有「判」，判須有文字、有結論，若這叫判，那媒體一天到晚都在判。

羅瑩雪： 若證據足准黃辭呈

對於在野黨立委要求批的第一件公文就是黃世銘辭呈，羅瑩雪則表示，若證據充分當然可批，但不能單憑立委要求就將檢察總長免職。羅瑩雪強調，特偵組若有監聽國會，要先確定到底是制度，或是人的問題，而不是說有警察包娼、包賭，就廢掉警察局。

司委會在臨時提案中，要求特偵組全面停止偵辦及監聽案件，而投票表決時，朝野黨團各有4位立委在場，但因為國民黨立委謝國樑沒投反對票，因此以4票對3票，通過臨時提案。

會後謝國樑表示，近來特偵組的爭議很多，若讓特偵組持續偵辦高敏感性案件，將無法取得社會正當性，人民也對特偵組沒信心，因此特偵組其偵辦案件暫停、回歸一般檢察機關，還算合理。

此外，委員會也決議將成立監聽調閱小組，要求相關單位提供參考資料，並請檢察機關徹查黃世銘是否涉有刑責。不過，裁撤特偵組及黃世銘即日起解職等臨時提案，經表決都沒通過。

廢特偵？江揆：就制度討論

特偵組因非法監聽，存廢引發討論，行政院長江宜樺30日表示，目前風波有兩個層面的討論，包括特偵組存廢與黃世銘去留，他希望人與制度分開看待，討論國家制度時，應著眼制度能否保障公民安全、維護司法獨立。並再次強調沒有「滅王小組」，不管是一人或五人。

江宜樺指出，特偵組成立於民進黨執政時期，其存在主要是查高官是否犯罪或涉不法；經過這次風波，大家可以重新思考特偵組存廢，但要就制度討論。也表示法務部已針對監聽事件成立調查小組，在還沒有調查結果之前，不要有太果斷的論斷。

江宜樺也相信調查小組會對監聽到國會總機給個清楚交代，呼籲調查小組在法務部長羅瑩雪的領導下要勿枉勿縱，若發現有違法行為，絕不寬貸。

郝龍斌：特偵監聽程序粗糙

針對監聽衍生風波，台北市長郝龍斌30日表示，人民有免於恐懼的自由，監聽必須在程序合法、非不得已絕不使用以及監聽範圍最小、傷害最少等前提下進行。

郝龍斌指出，這次特偵組的監聽不僅程序粗糙、調查結果也不實，不但特偵組公信力大大斲傷，民眾也對司法產生嚴重信任危機。◇

文化部部長龍應台今天表示，兩岸文化部組織結構不對等，讓兩岸文化對談碰到困難。所以原先暫定要在今年9月辦兩岸文化前瞻論壇，至今未成行。

龍應台赴立法院教育及文化委員會提出施政工作報告。現場有立委質疑，去年文化部編列2,400萬元要舉辦兩岸文化前瞻論壇，明年也編列1,500萬元，但此次施政報告卻沒有這項內容，質疑兩岸文化前瞻論壇是否要辦。

龍應台則回應，兩岸文化對談確實碰到困難，最主要在於兩邊組織結構不對等，文化部想要突破電影、流行音樂、出版等大項目，但北京文化部門並沒有整合影視、廣電、出版。
