一.行政罰法:第廿六條
「酒駕一罪不兩罰」的規定
是:2006年2月5日(民國95年)開始實施.

二.提問板大老公民國92年酒駕~
那時尚未有行政罰法.
(94年2月5日公佈):總統華總一義字第 09400016841 號令制定公布全文 46 條；並自公布後一年施行(95年2月5日)
 
所以提問板大的老公並不符合一行為不二罰的條文 .
(於法無據)

三.如果您是在95年2月5日以後到95年6月30日以前違規.已經被法院判決處罰金.就可以不用繳納這筆紅單罰款.

如果您是在95年7月1日以後違規.法院判決的罰金如少於這筆紅單應該繳納的金額.仍需要補繳差額給監理單位 。
(這叫做一行為不二罰).
