【呂志明／台北報導】家住台北市的女子，去年12月間前往台北醫學大學附設醫學院(簡稱北醫)，進行胃鏡檢查，事後卻控告當時幫他照胃鏡的張姓、高姓醫師及黃姓護理師，未將使用過的針頭妥善保管，害她被扎到感染愛滋病，台北地檢署調查後，認為3人無過失，今處分不起訴。

這名女子指控在完成胃鏡檢查後想吐，當時因為室內昏暗看到一個沒有蓋子、類似抽取式衛生紙盒的東西，就伸出左手想要抽取衛生紙，沒想到手一伸過去，手指就傳來陣陣刺痛，等到她仔細看了一下，才發覺盒子裡裝滿了用過的針頭。
 
事後女子檢驗得知感染HIV(愛滋病毒)，認為是當初在北醫照胃鏡時，被針頭扎傷造成的，認為當時看診的醫師、護士，對於內視鏡檢查室現場安全，有監督及維護的責任，3人涉犯業務過失致重傷害提出告訴。
 
台北地檢署收案後，立即將北醫內視鏡室，自2012年11月19日至女子照胃鏡當天(也就是案發前3周內)，針頭收集盒所有針頭，共計119名患者的名單，交由衛生署疾病管制局HIV資料庫比對，並未發現有被通報或列管的HIV個案。
 
另外檢察官也前往北醫內視鏡勘查，發現內視鏡檢查室針頭收集盒，擺放在工作區吊台下方的工作台，已避開病患的行經動線，盒身是紅色底貼有白底黑字「生物醫療廢棄物」警示標誌，盒蓋還有透明高蓋安全防護設計，應無誤認的可能，認為北醫3名醫師、護士並無過失，處分不起訴。
