諾基亞（Nokia OYJ）與宏達電纏訟逾一年的官司，宏達電首輪吞敗。

據彭博報導，美國國際貿易委員會（ITC）法官彭德（Thomas Pender）初步裁定，宏達電侵犯諾基亞兩項專利，另一項專利則未涉及侵權。諾基亞日前甫將旗下手機事業售予微軟（Microsoft）。

ITC這項裁決是初步裁定，尚須經ITC全體6名委員審議，並於明年1月23日做出最終判決。ITC有權阻止侵犯美國專利的產品進口。

ITC法官裁定，宏達電侵犯諾基亞一項有關刪除無線電訊號錯誤的專利，以及諾基亞另一項有關處理不同無線電頻率流程的專利。至於未涉及侵權的諾基亞第三項專利是有關將訊息由電腦傳送至手機的專利。

諾基亞曾蟬聯全球手機市占霸主長達十四年，在2011將寶座拱手讓給三星電子公司（SamsungElectronics Co.）。諾基亞想靠著專利授權回收研發手機的支出。諾基亞以72億美元將旗下手機事業與技術授權售予微軟後，諾基亞仍將保有這項專利。

總部位在芬蘭埃斯波（Espoo）的諾基亞，於2012年5月狀告宏達電侵犯其9項手機相關專利。

諾基亞發言人杜蘭特（Mark Durrant）表示，被裁定侵權的其中一項專利，與諾基亞在倫敦、德國杜塞道夫（Dusseldorf）與羅馬等地法院提告宏達電時所主張的技術相同。

杜蘭特表示，諾基亞樂見ITC裁定宏達電侵犯其兩項專利，「在諾基亞有機會檢視判決明細以前，將一概不予置評。」

宏達電法律顧問格雷斯．雷（Grace Lei）透過電郵指出，宏達電對於ITC裁定宏達電部分勝訴深感欣慰。他表示：「我們將期待ITC最終做出對宏達電有利的判決。與此同時，宏達電將確保替代方案準備就緒，以避免業務受挫。」

殷仔賽後接受美國媒體訪問，他談到今天比賽狀況說，「我只能說今天狀況不是很好，我努力嘗試把狀況調整回來」。
