林男與「小慧」發生性關係，經妻子葉婦發現表示要提告，小慧以任對方毆打，換取不要提告，但事後又控告葉婦傷害罪，致葉婦被判拘役20日。林男選擇站在妻子一方，出庭作證稱，與小慧發生另次性關係，法官依妨害家庭罪將小慧判刑3個月，並賠償精神慰撫金20萬元。
