立院初審 偷拍罰金增10倍

立院司委會今天初審通過「刑法」部分條文修正草案，將無故利用工具錄音、照相、錄影、以窺視、竊聽或記錄他人非公開活動及身體隱私部位的罰金，增加10倍，希望能落實保障隱私權。(程平報導)

隱私權受到憲法保障，但現今無故窺視、竊聽他人隱私的樣態多元，為落實保障隱私權，立法院司委會4號完成刑法部分條文修正案的初審程序，將無故利用工具，或是用錄音、照相、錄影、等方式，窺視、竊聽、或紀錄他人非公開的活動、談話、身體隱私部位處罰，在罰金部分增加10倍，最高可罰30萬元。會議主席民進黨立委吳宜臻表示，原本有委員認為用五官窺視、竊聽也該納入規範，但這次修法並沒有通過，因此在沒有利用工具的部分，還是回歸社會秩序維護法來處理。

另一方面，原本這次修法也要討論在「刑法」增列，針對妨害醫療人員執行醫療行為，要改成公訴罪，但由於日前衛環委員會已初審通過「醫療法」修正草案，納入此一概念，因此「刑法」就不再增訂。
