拍全家福遭超收定金　消保官要求改善

【李定宇／新北報導】新北市淡水一對夫妻日前喜獲麟兒，前往婚紗店欲拍全家福，雙方敲定拍攝總價9800元的全家福套餐，並支付總價5成、共4900元作為定金，怎料突因家中有事無法如期前往，欲向業者討回定金時，業者卻表示人力、攝影棚已經為其保留，僅能退回1900元，經夫妻向消保官申訴，雙方協商改為拍攝4900元全家福套餐。
 
消保官賴淑青表示，民法規定契約因可歸責於付定金當事人之事由致不能履行時，定金不得請求返還，但在婚紗攝影部分，該定型化契約範本規定，業者不得收取超過契約總價2成的定金，該業者違返規範，消保官已於協商當日要求業者改善。
