五次酒駕不改 法庭仍狡辯不悔法官重判十月

任職交通部的陳姓男子，過去曾有四次酒駕前科，今年二月間在新竹市再度酒後騎車被警方攔下，酒測值達0.79毫克。由於已是第五次酒駕，加上被告犯後毫無悔意，一再飾詞狡辯，法官罕見的依公共危險罪名，判處被告陳姓男子十個月徒刑，要陳姓男子入監反省。(彭清仁報導)

判決書中指出，被告陳姓男子具大專畢業學歷，並任職交通部所轄某單位，但被告卻從民國九十年到九十八年間，共犯下四次的酒駕前科。今年二月間，陳姓男子酒後騎機車，由於左搖右晃被警方發現而攔下，警方發現被告的酒測值達0.79毫克，因此將陳姓男子帶回派出所。

不過被告陳姓男子在法院庭訊時，卻一再否認犯行。而警方也提供偵訊時光碟供法官勘驗，發現被告在警局被查獲時根本語無倫次且答非所問，施以直線測試及平衡動作，結果為步行時左右搖晃、腳步不穩，身體前後或左右搖擺不定。但被告卻向法官辯稱筆錄時答非所問，是因為警員的態度不佳！而直線步行左右搖晃，是因為拍手才走不穩。法官審理後認為，被告陳姓男子上回酒駕被判六個月徒刑，竟絲毫未知誡惕，無視酒後不得駕車禁令，漠視刑法制裁，貿然酒後上路，缺乏尊重其他用路人生命、財產安全觀念，且犯後飾詞狡辯，態度不佳，一再否認犯行、毫無悔意，法官最後依公共危險罪，判處被告十個月徒刑，要被告入監反省。

今年犯太歲 真是流年不利 以前沒出過車禍的我 今年還遇到兩次 然後第二次又遇到一個流氓 發生如下： 昨晚我騎機車在兩線道，一台汽車內線要左轉，我看他沒動右側又有車就從他左側騎過去 結果他慢慢嚕，我就碰到他車輪，只是一點點碰到，我車沒倒，回頭看了一下就走了 然後他就衝過來逼車攔我，下來後就一直要動手動腳，所以我們就叫了警察 事後到交大做筆錄，他車沒事 我車也沒事，可是礙於他一直盧 警察就開了一張道交條例62：發生肇事未依規定處置 我當下是想說再去申訴，於是我今天查詢了一下法規 1.肇事定義：發生交通事故 2.事故：有人受傷、死亡或財損 我想請問的是，我們今天未發生受傷死亡或財損，我這樣算肇事不處置嗎 去監理所申訴可以過嗎 -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 61.219.70.170
