竊盜慣犯搭霸王車 判拘役45天

一名竊盜慣犯日前在新北市坐霸王車，從新店搭計程車前往烏來，車資共450元卻騙司機說，他要下車跟朋友拿錢再回來付車資，慣竊下車後就開溜。台北地院簡易庭認定，這名竊盜慣犯觸犯「詐欺得利罪」，判處拘役四十五天，可易科罰金四萬五千元。

判決書指出，今年3月15日凌晨4點多，一名沒有帶錢的竊盜慣犯李姓男子，在新北市新店區花園一路上的一家便利商店前方，招攬一輛計程車想搭乘霸王車。李姓男子告訴司機他要到烏來環山路的台車纜車站，並在抵達目的地後，向司機佯稱，他身上沒錢負擔450元的車資，所以要去找朋友拿錢再回來付款。司機不疑有詐放他下車，結果卻因為久候不見李姓男子才驚覺受騙，報警處理。

台北地院簡易庭認定，李姓男子觸犯詐欺得利罪。審酌李姓男子正值青狀，竟不思以正當手段謀取財產利益，以詐術詐取免付車資而享受載送服務的不法利益，迄今也沒有跟被害人達成和解，但念在他犯後坦承犯行、態度尚可，詐得利益也非鉅額，再加上李姓男子曾犯下多起竊盜案，視為累犯，衡量以後判處拘役45天，可易科罰金，全案可上訴。
