民事上訴二審訴訟費

裁判費由法院核定。通常會依據原審法院的標準去核定。
至於是依公告現值或市價，各法院做法並不一致。
以依據公告現值的做法比較多。
裁判費是由敗訴的當事人負擔。
例如，你第一審敗訴，上訴審費用由您繳交。如果你上訴審還是敗訴，不但要不回來，第一審裁判費還應由你負擔。如果你是被告，還要賠對方第一審裁判費。
如果你勝訴，則你可以向對於要回你第二審繳交的裁判費。如果你是原告，連第一審裁判費也可以要回來。
如果對方不主動支付，可以經由強制執行程序點回來。
